General Terms and Conditions for Training (TCT)

These terms and conditions apply to open courses offered by Synify. A course is considered open when participants from a variety of companies or professional associations can register for the course. Terms and conditions for a course may be developed in a program-specific course syllabus and will take precedence over these terms and conditions.

1. Introduction

These rules set out the general conditions for course registration as well as the rights and obligations of Synify learners. The learner must read and comply with these rules. The provisions of these rules are applicable in all premises of the institution, including virtual spaces. In premises outside of Synify, learners must respect the rules of these spaces.

2. Admission

To be enrolled in a program, the applicant must meet all the admission requirements and be on the class list. The decision whether or not to accept an application for a training program is made by those in charge of the training based on the prerequisites and the suitability of the candidate’s profile for the training, as well as other criteria relevant to the training. In the case of certification courses, an application may also be subject to a registration decision made by the appropriate department within Synify.

3. Data protection

By registering for a course or seminar, the participant agrees to the use of his/her personal data (contact information, statistics of courses taken, compliance with payment terms, behavior, etc.) by Synify for internal use. The participant also agrees that his or her personal data may be used by Synify for Synify’s own commercial or organizational purposes. However, they are never transmitted outside Synify except in anonymous form. A participant may request at any time to stop receiving promotional mailings from Synify.

4. Registration fees

All prices are in Swiss francs. The registration fee is payable in advance and non-refundable. In case of payment by installments, the full amount of the course fee can be received a maximum of 3 months after the start of the related course. The installment payment cannot exceed 3 monthly installments* (total amount divided by 3 and payable at the end of each month for a maximum of 3 months). Payment by instalments is systematically accepted if the request is made no later than 5 working days after registration. *A waiver is possible on a case-by-case basis but must in no case exceed 3 months after the beginning of the related course. The accepted methods of payment are the following: Bank transfer / Master Card / Visa / American Express The registration fee includes tuition, supervision of any personal work and examination fees. It does not include possible accommodation and travel expenses which are the responsibility of the candidate.

5. Termination of the course by the learner

  • For any cancellation announced 14 days (working and non-working) after registration, 100% of the registration fee will be refunded.
  • For any cancellation announced 15 working days* before the beginning of the course, 75% of the registration fee will be refunded.
  • From 14 to 10 working days* before the beginning of the course, 100% of the registration fee will be credited to the student’s account for a period of 12 months.
  • From 9 to 1 business day* before the beginning of the course, 100% of the registration fee will be due and no refund will be possible.
  • In case of cancellation after the beginning of the course, 100% of the registration fee will be due and no refund will be possible.
  • In case of cancellation after registration and up to 15 working days* before the start of the course, 25% of the registration fee is due.
  • In case of postponement of a course, the initial date of the course will be taken as the starting date for calculating the number of working days* in case of cancellation after registration.
  • In case of illness, accident, absence or following a failure or after cancellation of the program, the total amount of the registration fee is due. In case of cancellation, illness, accident or absence not communicated at least 24 hours before the beginning of a free training, a fee of 150 CHF (Swiss resident) / 50€ (European resident) / 50 CAD (Canadian resident) will be charged.

*Business days correspond to: Monday, Tuesday, Wednesday, Thursday and Friday.

Synify can define a minimum and/or maximum number of participants for a training. It can decide to cancel the training if the minimum number is not reached.

7. Changing, cancelling or postponing a program

Synify reserves the right to discontinue a program or postpone its start date. In the case of a postponement, registrations remain valid. In case of cancellation, Synify will refund the registration fee already collected but no further compensation of any kind. Courses offered by Synify are generally delivered in person or online. In the event that one of our training centers is unavailable or otherwise unavailable, Synify will provide distance learning in the form of a “Webinar” so that the disruption does not affect the smooth running of the course. These changes cannot be used as a claim or a refund of registration fees.

8. Certifications and course attestations

Certified training leads to a certificate or diploma from Synify. Non-certifying training leads to the issuance of a certificate of attendance. Each training program defines the modalities of control of the acquired knowledge. Only participants who have met all the required conditions for success receive a certificate or title. No Synify attestation, certificate or diploma will be issued in case of : – non-payment of the full course fee; – a course attendance rate of less than 80%; – an average grade of less than 4 out of 6. Registered students commit themselves to participate assiduously in the course, to respect the timetable and to notify Synify in case of absence or abandonment due to force majeure. When a session lasts more than two 45-minute periods, a refresher break of a maximum of 10 minutes for 3 periods, 15 minutes for 4 periods and 20 minutes for 5 periods is included in the course price. No course or session refund requests can be accepted because of these refresher breaks. For Synify training courses subject to specific rules, these rules are valid. Duplicates of attestations, certificates or diplomas must be requested in writing or through the student area (if accessible). They are subject to a fee. Synify may withhold certain documents if the tuition has not been paid in full.

9. Examination and knowledge test

Any case of fraud during exams and tests organized by Synify or its partners will result in the immediate exclusion of the learner and the sanctions provided for in the regulations of each training or certification may be applied.

10. Consumption and communication

The introduction and consumption of food and beverages is prohibited in the classrooms. Smoking is strictly forbidden on the premises of Synify, as well as in public buildings made available to Synify. The various means of communication such as mobile or cellular phones, pagers, etc. must be disconnected in the classrooms.

11. Right of access

Children and accompanying persons are not allowed in the classes. It is strictly forbidden to bring animals into the Synify premises and in any space made available. Bicycles are not allowed on the premises.

12. Hardware, Resources, Software and Data

Users must generally keep the equipment and documentation made available to them in good condition. They are obliged to use the Computer resources only in the context of actions for the transmission of knowledge, to the exclusion of other purposes. The software and data disseminated are protected by copyright (COPYRIGHT) and may only be reused for strictly personal use or disseminated by the learners with the prior and formal agreement of the author. Any copy is expressly forbidden. For the computer rooms, please refer to the Internal Regulations of the sector concerned. In the event of damage or fraudulent use of the information made available, the responsibility of the users is engaged and may lead to their exclusion or even prosecution. The learner agrees to receive communications from Synify for its training offer and for events related to Synify. The learner may unsubscribe at any time. The Synify logo and any protected Synify trademarked materials may not be used without Synify’s permission. Likewise, the creation of social network accounts in the name of Synify is strictly prohibited.

13. Duty of Respect

The behaviour of learners must take into account the duty of tolerance and respect for others in their personality and beliefs. Under no circumstances must they be physically or morally violent. The terms of this article also apply to the electronic means used by learners.

14. Safety, Hygiene

In terms of health and safety, the learner must strictly comply with both the general regulations and the specific instructions that will be brought to his attention by posters or any other means. In the event of an alarm in the various buildings, evacuation is done through the emergency exits in accordance with the relevant instructions.

15. Limitation of Synify’s Liability

Synify cannot be held liable for technical failure of the equipment or for any other reason that cannot be attributed to Synify. Synify cannot be held responsible for the theft of the personal belongings of participants or lecturers during the sessions or exams.

16. Intellectual Property

Synify and its partners are the sole owners of all intellectual property rights to all training content, in any form whatsoever (written, electronic or oral). As a result, all content and materials, in all forms, made available to participants on a private basis and as part of a training course, may not be used for any other purpose. In particular, they may not be used, transformed, reproduced or exploited in any other way without the express written consent of Synify.

17. Modification of programs and prices

Synify reserves the right to make program and price changes at any time without notice.

18. Jurisdiction

The legal relationship with Synify is subject to Swiss law and the place of jurisdiction is Lausanne.
